Goldrick Farrell Mullan provides advice to and conducts litigation on behalf of insurance companies with respect to policy coverage and therefore has a full understanding of the special rules of interpretation which apply to insurance policies. 


We can provide advice on the meaning and extent of cover under such policies, the effect of additional cover clauses, the effect of exclusion clauses, dual insurance issues, the effect of cover notes and the effect of multi-layered insurance facilities.  


Goldrick Farrell Mullan provides careful legal advice with respect to the extent and meaning of insurance policies but understands that there are commercial relationships between the parties and is able to provide practical advice in a commercial atmosphere.

  • Advice on modifications to indemnity and insurance clauses previously drafted in 1999 in light of recent decisions of the High Court of Australia 

  • Litigation dealing with the cover under a Product Liability Policy for a Cross Claim relying on a breach of implied terms under the Sale of Goods Act 

  • Advice and litigation with respect to recall, repair and replacement exclusion clause in a Products Liability Policy. Advice with respect to policy coverage for property damage caused by a mine accident 

  • Litigation in the New South Wales Court of Appeal concerning the meaning of a clause in a labour supply contract requiring insurance cover 

  • Advice concerning policy coverage for straying cattle on a road in circumstances where our client insured the owner of the property but the property was occupied by another party under a license

  • Litigation concerning interpretation of a Business Interruption Policy Advice and litigation with respect to the extent of cover in a dispute concerning the identification of the business activity of the insured

  • Advice with respect to the insurance cover needed for a complex transaction involving a large container ship to be chartered 

  • Advice on the effect of information technology hazards, computer data, program and storage media exclusion in a Product Liability Policy Advice on the effect of exclusion clauses and broker’s liability for failing to take out the appropriate insurance
