Our property team has extensive experience in acting in the sale and purchase of all different types of properties both residential and commercial properties including hotels, motels, service stations, offices, shops and restaurants. 

Property Development and Subdivision 

In property development we can draft all of the agreements required for the project including: project structuring and finance, construction and design and contracts for sale of units or lots off the plan.  We liaise with all relevant parties to assist the project to flow smoothly, advise on development consent compliance, draft community management statements, section 88B instruments and other documentation required as part of a development.

Additionally we attend to execution of the plan of subdivision and associated documentation by all relevant parties, attend to registration of the plan at the Land & Property Information Division of the Department of Lands and post- registration requirements.

Strata Law

We can advise clients in all aspects of Strata Law including disputes involving Owners Corporations, Strata Managers, residents, tenants, contractors and insurance companies. Our professional staff are experienced in Strata property development, conveyancing and leasing. We have a particular interest and expertise in asbestos issues in older strata buildings and can arrange Asbestos Audits for owners concerned with OH&S compliance issues.

Road Closures and Land Acquisitions

We act for public authorities and Councils on road closures and road widening, acquisition of land, and acquisition of easements.

Leasing and Licensing

We have experiences in acting for landlords and tenants in the lease of commercial, industrial and retail premises, lots and even airspace. Leases can be tailored to suit our client’s and the premises individual requirements. We advise clients on legislative compliance, particularly in relation to retail leases in addition to assisting with dispute resolution. When acting for prospective tenants we give comprehensive advice on the terms of the proposed lease, and advise on reducing insurance risk by ensuring that the warranty and indemnity obligations contained in the lease are within the terms of our client’s insurance coverage and negotiate for the amendment or removal of unreasonable clauses. Additionally we draft leases and licences of public land on behalf of Councils and Crown Reserve Trustees for the use of public land for commercial or charitable purposes.

GFM projects include:·      

  • Acting for and advising a NSW Electricity Generation Statutory Corporation with large infrastructure and property holdings in relation to the creation of easements over existing lines of infrastructure·  

      

  • Acting for a NSW Local Council in the purchase of commercial properties, acquisition of land for creation of new roads and road widening, acquisition of part of lots for expansion of Council’s infrastructure sites and creation of easements over pipeline sites·         

  • Advising in relation to a 75-unit Gold Coast development including development of an investment trust scheme, negotiation of options, acquisition of the project from original promoters, project funding, acquisition of numerous adjoining lots by conditional contract, consolidation of lots and development into units·   

    

  • Acting for and advising an ACT Developer in relation to a 20-unit ACT Unit title development·     

   

  • Acting for and advising an ACT landlord on leases of a shopping centre and commercial offices complex in Canberra
